Uncertain if Nikah Still Exists

Shortened Question:

The husband told the wife Talaq directly and indirectly several times, sometimes with direct words and sometimes with indirect words. Sometimes out of anger. Is their Nikah still valid?

Question:

The husband used the word Talaq on his wife several times in the past 5 to 6 months.

Recently he gave her Talaq while in a state of anger. Is this Talaq valid?

On another 2 occasions he told her mother over the phone “I have let your daughter free/let her go etc.”

While we were lying in bed out of anger he said, “Why don’t we get a divorce?”

There were also other instances when the husband was angry with his wife and shouted to her, “You divorcee.”

Can you clarify and explain the status of the Nikah?

The wife experiences her monthly cycle every 4 to 5 months. However during the time that these incidences were taking place she did not experience any menses.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle if a husband issues three Talaqs in one sitting or in separate sittings that constitute talaq-e-mugallazah (a permanently irrevocable divorce).[1]

Accordingly, in the enquired case, the nikah has been severed and the couple is no longer husband and wife.

The wife will have to spend her iddat as follows:-[2]&[3]

1)     If she experiences menses, her iddat will be three menses.

2)     If she does not experience menses, her iddat will be three months.

3)     If she is pregnant, her iddat will be until she gives birth.

The attitude of the husband is regrettable and may be detrimental to his relationship when dealing with others. It is advisable that he considers counseling.

After the iddat, the woman may marry another man.

[2]:” وإذا طلق الرجل امرأته طلاقا بائنا أو رجعيا أو وقعت الفرقة بينهما بغير طلاق وهي حرة ممن تحيض فعدتها ثلاثة أقراء ” لقوله تعالى: {وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاثَةَ قُرُوءٍ} [البقرة: 228] والفرقة إذا كانت بغير طلاق فهي في معنى الطلاق لأن العدة وجبت للتعرف عن براءة الرحم في الفرقة الطارئة على النكاح وهذا يتحقق فيها والأقراء الحيض عندنا.
