Is Nikah Valid

Shortened Question:

My parents went to my cousin’s house with a proposal,

Her parents telephoned accepting the proposal and also visited our home.

Both our families gather and had an engagement ceremony at the girl’s home.

The Mehr was decided and my mother placed an engagement ring on the girl’s finger.

Question:

My parents went Girl house with proposal, They were willing to give their daughter therfore The Family came to see our home and met us. (we are relatives)(i and the Girl love eachother)

then they(Parents of Girl) phone us that they like us and accepting the proposal. than, we had our engagement ceremony at Girl House, and my entire family attended. All family members gathered, Decided mehr and did Dua for our Future.  My mom put on ring to the girl. Wrote Mehr on Legal Stamp paper (I and 3 other family members signed it) As in Nikah, two male witness and mehr is required So Even our whole family was present My parents, Girl parents, around 15 males and females (without me) and Mehr was decided and also written on stampPaper.
But No NIKAH or Qabul word was used or Exchange. Is This Nikah Valid? Thankyou

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

For a Nikah to be valid there must an offer and an acceptance in the presence of two witnesses.[i]

In the enquired case Nikah did not take place.

[i]:قال: ” النكاح ينعقد بالإيجاب والقبول بلفظين يعبر بهما عن الماضي ” لأن الصيغة وإن كانت للإخبار وضعا فقد جعلت للإنشاء شرعا دفعا للحاجة ” وينعقد بلفظين يعبر بأحدهما عن الماضي وبالآخر عن المستقبل مثل أن يقول زوجني فيقول زوجتك ” لأن هذا توكيل بالنكاح والواحد يتولى طرفي النكاح على ما نبينه إن شاء الله تعالى ” وينعقد بلفظ النكاح والتزويج والهبة والتمليك والصدقة
